These Terms of Use (“Terms”) are a legal agreement between you and Hillwork, LLC (“Hillwork,” “we,” “us,” or “our”) governing your access to and use of the Thankhill web application and related services (collectively, the “Service”) at https://thank.hillwork.net.

By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Thankhill is a gratitude journaling product that lets you record notes and related content, optionally share with groups, and use features we may add or change over time. We may modify, suspend, or discontinue any part of the Service with or without notice. The Service is provided “as is” and “as available.”
2. Eligibility
You may use the Service only if you are at least 18 years old, capable of entering into a binding contract with Hillwork, and not barred from using the Service under applicable law. If you are under 18, do not use the Service or create an account.
The Service is intended for adults. We do not knowingly allow registrations from anyone under 18. If you believe someone under 18 is using the Service, contact support@hillwork.com.
3. Your account
You may need to create an account (for example, via Google Sign-In or email one-time code). You are responsible for account activity, for keeping sign-in methods secure, and for providing accurate information. You must notify us if you become aware of unauthorized use of your account.
We may refuse service, close accounts, or limit access to protect the Service, our users, or others.
4. Acceptable use
You agree not to:
- Violate any law or third-party right (including privacy, intellectual property, and data protection laws).
- Upload, post, or share content that is unlawful, defamatory, harassing, hateful, obscene, or that promotes harm or illegal activity.
- Interfere with or disrupt the Service, servers, or networks; attempt unauthorized access, scraping, or security testing without our prior written consent.
- Use the Service to distribute malware, spam, or misleading or fraudulent content.
- Reverse engineer, decompile, or attempt to extract source code from the Service except to the extent permitted by law.
- Use automated means to access the Service in a way that imposes an unreasonable load or bypasses access controls.
We may investigate and take action—including removing content, suspending or terminating access, and cooperating with law enforcement—if we believe you have violated these Terms or the law.
5. Your content
You retain any rights you have in text, images, and other content you submit to the Service (“User Content”). You are responsible for your User Content and represent that you have the rights needed to use and share it.
To operate the Service, you grant Hillwork a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and process User Content solely to run, improve, and secure the Service and as described in our Privacy Policy (for example, showing your notes to you, or to a group you choose). This license ends when you delete the content or your account, subject to reasonable backup and technical retention.
6. Third-party services and sign-in (including Google)
The Service may integrate third-party services (for example, browser push infrastructure or email delivery). Those services have their own terms and privacy practices.
If you use Sign in with Google, your use is also subject to Google’s applicable terms and policies (for example, the Google Terms of Service and Google’s user policies for the products you use). We access Google user data only as described in our Privacy Policy and in the limited ways needed to provide sign-in. We do not use Google user data in ways that violate the Google API Services User Data Policy (including Limited Use where it applies).
7. Fees
The Service is currently provided free of charge unless we notify you otherwise in these Terms, on the Service, or by email. If we introduce paid features or subscriptions, we will describe pricing and obtain any required consent before you incur charges.
8. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Journaling and well-being tools are not a substitute for professional medical, mental health, or legal advice. If you are in crisis, contact local emergency services or a qualified professional.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: IN NO EVENT WILL HILLWORK, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50). Because the Service is currently offered without charge, (A) may be zero; in that case this cap is FIFTY U.S. DOLLARS (US $50).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
10. Indemnity
You will defend, indemnify, and hold harmless Hillwork and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if we are required to by law, or for operational or security reasons.
You may delete your account through features we provide where available; deletion is described in our Privacy Policy. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, indemnity, and governing law) will survive.
12. Copyright notices
If you believe material on the Service infringes your copyright, send a notice to support@hillwork.com with the information typically required under U.S. law (including identification of the work, the allegedly infringing material, your contact information, and statements required by 17 U.S.C. § 512).
13. Governing law and venue
These Terms are governed by the laws of the State of Oregon and applicable federal law of the United States, without regard to conflict-of-law rules. You and Hillwork agree that the state and federal courts located in Multnomah County, Oregon have exclusive jurisdiction and venue for any dispute arising from or relating to these Terms or the Service, and you consent to personal jurisdiction in those courts.
14. Changes
We may modify these Terms from time to time. We will post the updated Terms on this page and update the effective date. If changes are material, we may provide additional notice (for example, by email or in-product notice). Your continued use after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree, stop using the Service.
15. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Hillwork regarding the Service and supersede prior agreements on the subject.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Severability. If a provision is invalid or unenforceable, the remaining provisions remain in effect.
- Export. You must comply with applicable export and sanctions laws.
